Fair Use Policy

About this Policy
A23D offers subscription plans with unlimited downloads, designed to give creators the freedom to explore, test, and use assets efficiently in their creative workflows. To ensure a high-quality and sustainable service for all users, unlimited downloads are subject to this Fair Usage Policy.
This policy supplements and forms part of the A23D Terms of Service and License Agreement, is legally binding, and is designed to keep things fair for A23D, our content partners, and all users. This policy exists to prevent misuse of the platform while ensuring that normal, legitimate creative usage is never disrupted.
What “Unlimited Downloads” Means
Unlimited downloads mean that there is no fixed per-asset cost or credit system and that subscribers may download assets freely while their subscription is active.
Unlimited does not mean unrestricted, automated, abusive or excessive downloading, or unlimited mass extraction of content, nor does it permit usage patterns that negatively affect platform performance, content creators, or other subscribers.
Most users will never be affected by this policy.
Intent to Use Requirement
You must only download assets that you reasonably intend to use in a legitimate project.
Downloading assets solely to store, archive, build private libraries, mirror the A23D library, or prepare for use after your subscription has ended is strictly prohibited.
Downloading assets for the purpose of creating, training, testing, validating, benchmarking, fine-tuning, improving, operating, or supplying datasets for any machine learning, artificial intelligence, generative, or data-mining systems is also strictly prohibited.
Fair and Normal Usage
Fair usage refers to download activity that is consistent with typical creative, professional, or commercial use, including but not limited to:
- Browsing and downloading assets for active or planned projects
- Testing different assets before selecting the most suitable one
- Downloading assets over time as part of ongoing creative work
- Individual or team usage aligned with the subscribed plan
- Manual downloads performed by a human user through the A23D platform
Unfair or Prohibited Usage
The following activities are considered unfair usage and are not permitted:
- Excessive, abnormal, or unusual download behavior inconsistent with genuine creative needs
- Automated, scripted, crawler-based, or bot-driven downloading
- Bulk downloading, scraping, mirroring, or harvesting of content
- Stockpiling assets for future use after subscription expiration
- Building competing libraries, datasets, archives, or training collections
- Sharing, reselling, redistributing, sublicensing, or making assets publicly available
- Using multiple accounts to bypass monitoring or restrictions
- Account sharing beyond what is permitted by the subscribed plan
- Attempting to bypass, manipulate, or interfere with download controls, tracking systems, or fair-use enforcement mechanisms
- Any activity that places unreasonable strain on A23D infrastructure or services
Monitoring and Fair Use Warnings
A23D may monitor download activity to identify unusual or potentially abusive patterns. A23D is not obligated to provide any warning prior to taking enforcement action.
If your activity approaches levels that may be considered excessive or abnormal, you may receive a soft fair-usage warning. These warnings are informational and intended to allow you to adjust your usage before any restrictions are applied.
Enforcement and Restrictions
At our sole discretion, A23D reserves the right to take appropriate action to protect the platform, including but not limited to:
- Applying temporary download limits
- Temporarily restricting access to downloads or other subscription features
- Reviewing and investigating account activity
- Suspending or terminating subscriptions in severe or repeated cases
These remedies are in addition to any other rights or remedies available to A23D under applicable terms or law. A23D may take such action immediately and without prior notice or liability where necessary to prevent misuse or protect platform integrity.
Legitimate High-Volume Usage
We understand that some users may have legitimate needs to download higher volumes of content. Restrictions may be removed once legitimate usage is verified.
If you anticipate high-volume usage, we encourage you to contact A23D Support so we can assist you and help avoid unnecessary restrictions.
A23D reserves the right to request reasonable proof of legitimate use.
Plan Differences
Fair-usage thresholds may vary by subscription plan, user type, number of seats, and usage patterns. Higher-tier plans are designed to accommodate higher levels of legitimate usage.
A23D does not publicly disclose specific usage thresholds, and these thresholds may change over time to reflect platform capacity and usage trends.
Transparency and Changes
This Fair Usage Policy may be updated at any time to reflect changes in technology, platform usage, or business requirements. Continued use of A23D constitutes acceptance of the current version of this policy.
